TERMS AND CONDITIONS OF GIFT CERTIFICATE (and/or GIFT CARD)
WHEREAS the Customer has purchased a gift certificate, whether e-gift card, voucher or plastic gift card and includes the accompanying e-mail or SMS text message (“Text Message”) provided at purchase (“Gift Card”) from 7 Points Star Park Inc. (the “Campground”) and the Customer understands and acknowledges that the below terms and conditions apply to the Gift Card:
1. Non-refundable
The Gift Card shall be non-refundable and once purchased shall only be used to purchase ordinary services provided by the Campground, being the reservation and rental of campground sites (the “Services”) located at 4937 Highway 123, Redbank, New Brunswick (the “Campground Location”).
2. Assignment
The Gift Card may be assigned by either the Customer or the Campground without the consent of the other party.
3. Operations Date
The Gift card shall only become available for use on the first season of operation of the Campground, following the official opening which is anticipated in 2025 and will be communicated to the gift card holder at the email provided at purchase and posted on the website at “www.7points.site” after the official grand opening date comes available and gift cards are able to be used.
4. Availability Disclosure
This Gift Card does not guarantee or reserve availability/space at the Campground Location in and of itself. The Customer must still be successful in reserving space at the Campground Location to apply the Gift Card.
5. Method of Payment
The Customer shall only apply the Gift Card to a purchase of the Services online. The Gift Card shall not be applied with an in person purchase of the Services at the Campground Location, and the Campground reserves the right to refuse the application of the Gift Card against any purchase price for the Services in person.
6. Seasonal Operation
The Campground and the Services are offered seasonally and the exact dates of operation are subject to change at the sole discretion of the Campground. Please visit “www.7points.site” (and/or any link redirected from this address) to see announcements related to the opening and closing each season.
7. Further Terms and Conditions
(a) If any term, condition, clause, covenant or provision herein is determined or held to be void, invalid or unenforceable in whole or in part, it shall be deemed to be and shall be severed from the valid and enforceable clauses, covenants and provisions , and any term, condition, clause, covenant or provision so severed shall not be deemed to affect or impair the validity of any other term, condition, clause, covenant or provision, which the parties agree shall remain in full force and effect.
(b) This Gift Card and the rights and obligations of the parties, shall be governed by and construed and enforced in accordance with the laws of the Province of New Brunswick.
(c) The division of these terms and conditions into paragraphs and the insertion of headings is for convenience of reference only and shall not affect the construction or interpretation of these terms and conditions.
(d) The Gift Card has no cash value and cannot be redeemed for cash.
(e) The Gift Card may not be duplicated, copied, or sold.
(f) The Gift Card may only be valid for a specified period of time, as stated on the Gift Card.
(g) The Campground reserves the right to change the terms and conditions at any time without prior notice.
(h) Lost or stolen gift certificates will not be replaced.
(i) Gift certificates are subject to all applicable laws and regulations, including the Gift Card Act (New Brunswick)
(j) The recipient of a gift certificate must comply with all rules and restrictions of the Campground.
(k) The recipient of the gift certificate/e-gift card or physical gift card acknowledges that at purchase of the gift card all information issued by the campground regarding expiry and how to check information about the gift card, including how to obtain the balance, and that the original email or text itself for any gift cards sent electronically is considered to be part of the gift card and MUST be included with the gift card at any time it is forwarded for another user to redeem to allow it to be considered valid.
(l) If anyone requests a copy of the email or text sent with the e-gift card at purchase from 7 Points Star Park Inc. and/or at 7Points.site they will not be unreasonably denied a copy of any agreement terms attached along with the original purchase which could potentially interfere with validity of the gift card and/or resulting redemption.
